Terms and Conditions for the RCS service experience over a Trivia Game named Conecta y Responde

Welcome to Connecta y Responde (the "RCS Experience"), a free weekly online trivia game operated by Jibe ("we", "us", or "our"). These Terms and Conditions (the "Terms") govern your participation in the RCS Experience through the RCS ("Rich Communication Services") messaging service using an interactive bot within your mobile device's native messaging application.

By participating in the RCS Experience (e.g., by initiating a conversation with the bot or answering questions), you agree to these Terms in their entirety. If you do not agree with any of these Terms, you must not participate in the RCS Experience.

1. Service Description

The RCS Experience consists of a free weekly trivia match. Users interact with a bot via the RCS functionality of their native mobile messaging app. No additional application download or installation is required. Participation is free, without prejudice to any potential data or messaging costs that your mobile operator may apply for the use of the SMS/MMS/RCS service.

3. How to Play and Rules of Conduct

To start the game, follow the instructions provided by the RCS bot.

Participate in the weekly matches by answering the questions sent by the bot.

You agree to participate honestly and not use fraudulent means, cheats, automated bots (other than ours), scripts, or any other unauthorized methods to gain an advantage in the RCS Experience.

You agree not to use the service to send offensive, illegal, defamatory, harassing, or inappropriate messages.

You will not attempt to reverse engineer, decompile, interfere with, or disrupt the operation of the bot or the RCS Experience service.

Failure to comply with these rules may result in disqualification from the weekly match and/or suspension or permanent termination of your access to the RCS Experience.

4. Intellectual Property

All content of the RCS Experience, including, but not limited to, questions, answers, text, graphics, logos, the bot's design, and the underlying software, are the exclusive property of Jibe or its licensors and are protected by intellectual and industrial property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and participate in the RCS Experience solely for your personal, non-commercial use, in accordance with these Terms.

5. Privacy and Data Protection

The collection and use of your personal data (such as your phone number and messages exchanged with the bot) are governed by our Privacy Policy, which forms an integral part of these Terms. By participating in the RCS Experience, you consent to the practices described in the Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and the Spanish Organic Law on Data Protection and guarantee of digital rights (LOPDGDD). You have the right to access, rectify, erase your data, as well as other rights explained in our Privacy Policy.

6. Disclaimer of Warranties and Limitation of Liability

The RCS Experience is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not warrant that the RCS Experience will be uninterrupted, secure, or error-free, nor that RCS functionality will always be available or work correctly on your device or carrier network.

To the maximum extent permitted by law, Jibe shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your access to, use of, or inability to use the RCS Experience or the RCS service.

We are not responsible for any data or messaging costs incurred through the use of the SMS/MMS service via your mobile operator.

7. Modifications to the Terms or Service

We reserve the right to modify these Terms or the features of the RCS Experience (including its possible discontinuation) at any time. If we make material changes, we will notify you via the RCS bot or by other reasonable means before the changes take effect. Your continued use of the RCS Experience after notification of changes will constitute your acceptance of the new Terms.

8. Termination

You may stop participating in the RCS Experience at any time simply by ceasing interaction with the bot. We reserve the right to suspend or terminate your access to the RCS Experience, at our sole discretion, at any time and for any reason, including, without limitation, if you breach these Terms.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising in connection with these Terms or the RCS Experience shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, unless consumer protection regulations establish a different venue.
